These Terms and Conditions (“Terms“) govern your use of EducationalEngine.com and its AI-powered tools (the “Service“). The Service is operated by Jempitona Pty Ltd (ABN 16 142 831 187) trading as Educational Engine (“we“, “us“, “our“).

By creating an account, purchasing credits or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded. Where these Terms say something that would otherwise conflict with those rights, those rights prevail.

2. Eligibility and accounts

  • You must be at least 18 years old to create an account.
  • You must give accurate information when you register and keep it up to date.
  • Your account is for your own use. You must not share your login or let anyone else use your account.
  • You are responsible for keeping your password secure and for all activity under your account. Tell us promptly if you believe your account has been accessed without permission.

3. The Service

Educational Engine provides AI-assisted tools that help educators create teaching materials such as lesson plans, assessments, case studies and rubrics. We may add, change or remove tools and features over time. We aim to keep the Service available, but we do not guarantee it will be uninterrupted or error-free, and it may be unavailable during maintenance or because of events outside our control.

4. Credits

The Service uses credits. Each tool shows its credit cost on the relevant button before you use it.

  • Free credits. New accounts may receive free credits. Free credits may carry an expiry date, and we may change or withdraw free-credit offers at any time for new sign-ups.
  • Purchased credits. You can buy credit packs. The number of credits, the price and any expiry period are shown on the product before you purchase.
  • Expiry. Credits expire at the end of the period shown for the pack they came from. Expired credits cannot be used, restored or refunded, except as required by the ACL. When you spend credits, we use the credits closest to expiry first.
  • No cash value. Credits have no cash value, cannot be exchanged for money, and cannot be transferred, sold or shared between accounts.
  • Failed generations. If a generation fails because of a fault on our side, we will restore any credits deducted for it.
  • Price changes. We may change credit costs or pack prices at any time. Changes do not affect credits you have already purchased, but future generations will use the credit cost displayed at the time.

5. Payments

Prices are shown at checkout and include GST where applicable. Payments are processed by our third-party payment provider (currently PayPal), and your payment is also subject to that provider’s terms. We do not store your full card or bank details. Credits are added to your account once payment is confirmed.

6. Refunds

We do not offer refunds for change of mind, for credits that have been purchased but not used, or for credits that have expired. This does not affect your rights under the ACL. If the Service has a major failure, or credits were charged because of an error on our part, you may be entitled to a refund or remedy — please contact us.

7. AI-generated content

The Service uses artificial intelligence to generate content (“Output“). You acknowledge that:

  • Output may be inaccurate, incomplete, out of date or unsuitable for your purpose. It can contain errors that sound plausible.
  • Output is a starting point, not a finished product. You are responsible for reviewing, checking and adapting all Output before you use it, including checking facts, references, clinical or technical content, and alignment with your curriculum and assessment requirements.
  • Output is not professional, medical, clinical, legal or other expert advice, and must not be relied on as such.
  • You are responsible for making sure your use of Output complies with your institution’s policies, including policies on academic integrity, assessment and the use of AI.
  • Other users may receive Output that is similar or identical to yours, and we do not guarantee that Output is original or unique.

8. Your inputs

You are responsible for the information you enter into the Service (“Inputs“).

  • Do not enter personal, health or sensitive information about students, patients or other people, or any confidential information you are not permitted to share.
  • Only enter material you have the right to use. Do not enter third-party material in breach of copyright or confidentiality obligations.
  • To generate Output, your Inputs are sent to third-party AI providers (such as OpenAI or Anthropic), who process them on our behalf.
  • You give us a licence to store, process and transmit your Inputs and Output as needed to provide, maintain and improve the Service, and to meet our legal obligations.

9. Ownership

As between you and us, you own your Inputs, and you own the Output generated for you to the extent any intellectual property rights exist in it. You may use Output in your teaching and professional work. We (or our licensors) own the Service itself, including the website, software, design, prompts, branding and all other content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these Terms.

10. Acceptable use

You must not:

  • use the Service for any unlawful, harmful, misleading or fraudulent purpose;
  • generate content that is defamatory, discriminatory, harassing, sexually explicit or otherwise objectionable;
  • attempt to access other users’ accounts or data, or interfere with the security or operation of the Service;
  • scrape, copy, resell or commercially redistribute the Service, or use automated means to access it without our written permission;
  • reverse engineer the Service or use it to build a competing product; or
  • create multiple accounts to obtain additional free credits.

11. Storage of your generated items

We store items you generate in your account so you can view and download them later. We do not guarantee that stored items will be kept indefinitely, and we may introduce a retention period for stored items in future. If we do, we will give you reasonable notice before any existing items are removed. We recommend keeping your own copies of anything important.

12. Privacy

We handle personal information in accordance with our Privacy Policy, which explains what we collect, how we use it and who we share it with.

13. Third-party services

The Service relies on third-party providers, including payment processors, AI model providers and hosting services. We are not responsible for the acts or omissions of those providers, but we choose them carefully and this does not limit your rights under the ACL.

14. Limitation of liability

To the maximum extent permitted by law, and subject to section 1:

  • we are not liable for any indirect or consequential loss, or for loss of data, profits, reputation or opportunity, arising from your use of the Service or of any Output;
  • we are not liable for any loss arising from your reliance on Output without appropriate review; and
  • where our liability for failing to comply with a consumer guarantee can be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

Otherwise, and to the extent permitted by law, our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

15. Suspension and termination

You may stop using the Service and ask us to close your account at any time. We may suspend or close your account if you breach these Terms, if we are required to by law, or if your use puts the Service or other users at risk. If we close your account because of your breach, any remaining credits are forfeited, subject to the ACL. If we permanently discontinue the Service for reasons other than your breach, we will refund the unused, unexpired portion of any credits you purchased.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new “last updated” date, and for significant changes we will take reasonable steps to notify you, such as by email or a notice on the site. By continuing to use the Service after changes take effect, you agree to the updated Terms.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
